Terms of Reference (ToR): Appointment of a Consultant with Legal Expertise for Mpumalanga Green Cluster Agency
1. Background
The Mpumalanga Green Cluster Agency (MGCA) is dedicated to fostering sustainable development and environmental protection within the Mpumalanga Province. To achieve its mandate, the MGCA requires the services of an expert with environmental and legal expertise to advise the MGCA on various matters, including but not limited to regulatory compliance, contractual agreements, and environmental legislation.
2. Objective
The objective of this Request for Quotations (RFQ) is to appoint a qualified and experienced consultant with environmental and legal expertise to provide comprehensive legal and environmental advice and services to the MGCA on an as-needed basis.
3. Scope of Work
The appointed consultants will be expected to provide the following services:
- Regulatory Compliance: Advising on compliance with national, provincial, and local environmental regulations.
- Contractual Agreements: Drafting, reviewing, and negotiating contracts and agreements related to the MGCA’s operations.
- Environmental Law Services: Advising the MGCA on environmental related matters.
- Policy and Legislative Advice: Providing updates and interpretations of relevant environmental laws and policies.
- Risk Management: Identifying and advising on potential legal risks and mitigation strategies.
- Ad hoc Legal Advice: Providing general legal advice on various issues as required by the MGCA.
4. Deliverables
The consultant will be required to deliver the following:
- Written legal opinions and advice.
- Drafting and review of contracts and agreements.
- Interpretation of various legislation .
- Regular updates on relevant legislative changes.
- Detailed reports on legal risks and recommended actions.
- Recommending law firms on litigious matters.
5. Duration of Appointment
The appointment will be for an initial period of one (1) year, with the possibility of extension based on performance and the MGCA’s needs and requirements.
6. Qualification and Experience Requirements
The legal service practitioner must meet the following criteria:
- An LLB Degree (master’s degree in law will be an advantage).
- At least five (5) years of experience in environmental law and related fields.
- Proven track record in providing legal services to public sector organizations or similar entities.
- Excellent understanding of South African environmental law, regulations and policies.
- Strong analytical, negotiation, and communication skills.
7. Evaluation Criteria
Quotations will be evaluated based on the following criteria:
- Qualifications and Experience: Relevance and depth of experience in environmental law.
- Approach and Methodology: Understanding of the scope of work and proposed approach to deliver the required services.
- Cost: Competitive pricing and value for money.
- References: Positive feedback from previous clients.
